The Income-Tax Appellate Tribunal is presently consti-tuted under the Income-Tax Act 1961 . आयकर अपील अधिकरण इस समय आयकर अधिनियम , 1961 के अधीन गठित है .

The Appellate Tribunal is also deemed to be a Civil Court for all the purposes of Section 195 and Chapter XXVI of the Code of Criminal Procedure 1973 . दंड प्रक्रिया संहिता 1973 की धारा 195 और अध्याय 26 के प्रयोजनार्थ अधिकरण को सिविल न्यायालय माना जाता है .

According to the Act the aggrieved party can appeal against any of the above actions to an Appellate Tribunal which has been constituted under the Act by the central government to hear appeals . अधिनियम के अनुसार व्यथित पक्ष उपर्युक़्त किसी कार्रवाई के विरुद्ध एक अपील अध्Lकरण में अपील कर सकता है जिसका गठन केंन्द्र सरकार ने इस अधिनियम के अधीन अपीलों की सुनवाई के लिए किया है .
